1. Acceptance of Terms

Welcome to 333 Haus ("we," "us," or "our"). By accessing or using our website, storefront, point-of-sale systems, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service and Terms of Use (these "Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all visitors, customers, and others who access or use the Service.

2. The Service

333 Haus designs and sells custom drinkware, stickers, posters, and related products. The Service includes our online storefront, in-person point-of-sale (POS) checkout, customer accounts, loyalty rewards, and order fulfillment through third-party print-on-demand providers. We may modify, suspend, or discontinue any part of the Service at any time without notice.

3. Accounts & Registration

You may create an account to track orders, earn loyalty rewards, and save preferences. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your password and for any activity conducted under your account. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and place orders.

4. Orders, Pricing & Availability

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at any time, including for pricing errors, suspected fraud, or inventory issues. Prices are shown in U.S. dollars and may change at any time. Applicable taxes and shipping are calculated at checkout. If your order is cancelled before fulfillment, we will issue a full refund.

5. Payment Processing (Stripe)

Online payments on the Service are processed by Stripe, Inc. ("Stripe"), a third-party payment processor. By submitting a payment, you authorize us to charge your designated payment method through Stripe, and you authorize Stripe to process the transaction on our behalf.

Your payment is governed by Stripe's applicable terms, including the Stripe Services Agreement, the Acceptable Use Policy, and your card issuer agreement. Stripe may decline a transaction at its discretion. We do not store your full card number or CVV — those are collected and tokenized directly by Stripe.

When you complete a purchase, certain transaction and customer information — including your name, billing and shipping address, email, phone number (if provided), payment method type, and order details — is transmitted to Stripe to authorize, process, and settle the payment, to help prevent fraud, and to provide customer support. Stripe processes this data as an independent controller and processor under its own Privacy Policy. We do not share your payment card details with any party other than Stripe for the purpose of processing your payment.

6. Google Analytics & Cookies

We use Google Analytics, a web analytics service provided by Google LLC ("Google"), to understand how visitors use our site. Google Analytics uses cookies and similar technologies to collect and analyze traffic data, including pages visited, time on site, referring source, device type, and approximate geographic region (derived from IP address).

The information generated by these cookies about your use of the Service is generally transmitted to and stored by Google on servers in the United States. Google may transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. We do not use Google Analytics to collect personally identifying information such as your name, email, or billing details, and we do not link Google Analytics data to your account in a way that identifies you personally.

You can opt out of Google Analytics tracking by installing the Google Analytics Opt-out Browser Add-on, or by disabling cookies in your browser. We do not circumvent any privacy or opt-out features provided as part of the Service. Your use of the Service is also subject to Google's Google Analytics Terms of Serviceand Google's Privacy Policy.

7. Privacy & Your Data

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Our Privacy Policy is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy, including the collection of traffic data via cookies as described in Section 6.

8. Loyalty Program

Loyalty points and rewards have no cash value and are non-transferable. We may modify or terminate the loyalty program at any time. Points earned are subject to the program terms in effect at the time of redemption. We reserve the right to void points obtained through fraud or abuse.

9. Intellectual Property

All content on the Service — including text, graphics, logos, designs, artwork, and software — is owned by 333 Haus or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent. Product designs and artwork remain the property of 333 Haus.

10. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Submit false, misleading, or fraudulent order or account information.
• Attempt to interfere with, disrupt, or gain unauthorized access to the Service or its systems.
• Use the Service to transmit viruses, malware, or harmful code.
• Resell, scrape, or misuse product content, pricing, or data.
• Abuse, reverse-engineer, or circumvent any security, payment, or privacy feature of the Service.

11. Product Fulfillment & Returns

Custom and print-on-demand products are manufactured to order. Production and shipping times are estimates and not guarantees. If you receive a defective or incorrect item, please contact us within 14 days of delivery for a replacement or refund. Because products are custom-made, we generally do not accept returns for change of mind.

12. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

13. Limitation of Liability

To the maximum extent permitted by law, 333 Haus and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the preceding 12 months.

14. Indemnification

You agree to indemnify and hold harmless 333 Haus and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. Upon termination, all provisions of these Terms that by their nature should survive termination shall remain in effect.

16. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

17. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Texas.
